​​​The Agency for the Cooperation of Energy Regulators (“the Agency") invites third parties to submit their views with respect to the Agency's proceeding to decide on the single capacity booking platform(s) to be used at the border between Germany and Poland, at the “Mallnow" physical interconnection point (“Mallnow IP") and at the “GCP" virtual interconnection point (“GCP VIP").

On the 19 April 2018, the National Regulatory Authorities of Germany and Poland referred the selection of a single web-based booking platform for the booking of bundled gas transmission capacity on the border between Germany and Poland to the Agency. On 16 October 2019, the Agency decided on the platform to carry out the auctions at the above-mentioned interconnection points for a period of no longer than three years.

On 14 February 2019, the Board of Appeal of the Agency annulled the Decision of 16 October 2018.

By 14 August 2019, in accordance with Article 37(3) of Commission Regulation (EU) 2017/459 of 16 March 2017 and in accordance with the procedural provisions of Article 8(1) of Regulation (EC) No 713/2009, the Agency will adopt a new decision.

1.          The Consultation

The Agency has taken into account the results of the public consultation of 5 June 2018[1] on a proceeding having the same subject matter.

With the consultation, the Agency is asking input on the following three aspects:

1.          Legal requirements (confirmation);

2.          Governance;

3.          IT requirements (self-assessment and case study, see further information later in the notice).
